H1 or H4?

Postby Maanyaa on Fri Mar 21, 2008 3:16 pm

Hello all,

Need your guidance as I am stuck in a strange situation!

My company is planning to file for my H1 this year. However, I am getting married to a person who's already working in California on H1. I have plans of studying MBA in the future. Given this, what should I go for:

1. Allow my H1 to get filed. In case I get the visa, go to US. Work for certain time (around an year or more) and then
1. Either study part-time MBA or
2. File for a F1 (student visa)
In this case, would H1 to F1 conversion be easy?

2. Go for a H4 (dependent visa) and eventually file for a F1 visa.

The issue which is putting me into a fix is this: which conversion is easier - H1 --> F1 or H4 --> F1? Besides, is it okay if I 'throw away the chances of H1' (as my friends put it) and go for an H4?

Which of these two would be a better option? May I know the pros and cons of both?

Thanks,
Maanyaa

Hi,I am currently staying in SFO and have been cribbling over the fact that I am on h4
so pls pls dont come on h4 if u have an h1 handy

h4 is like a death trap and since economy is in bad shape, its not advisable.
h1-to-f1 is gr8
f1 to h1 is also not a problem as now u can be on OPT for 28 months and thats enough time to find a job
